Mail Notification module conflict with Terms checkbox and payment

Hi,

 

I have set up a one-page checkout for our website. It currently is set such that only after the user clicks on "I agree" the payment options are shown.

 

Sometimes, perhaps at rare occurrences or when the mail notification module is enabled, there is an error and the payment options don't show up when the check box is clicked. Then when you refresh or reload it takes you to the "order confirmation" page and you are unable to do anything then. You can't cancel the order because you must confirm it and you can't even go back. Then when you confirm and pay through Paypal, the payment is deducted but it shows "Invalid new order state" error.

 

I think this is a conflict with the "mail notification" system as I read in some other posts as well. I wonder what its resolution would be?
