First time navigating to Cart doesn't force https! Results in "Permission denied" error

Update:

I just noticed found a similar issue here:

Apparently it was solved in v1.3 but I have 1.3.1? Is it possible the problem still persists in 1.3?

This causes:

1) An error message in IE (see below)
2) The cart block to "freeze". I've seen this happen in IE and Safari

Even when you refresh the page this doesn't fix it. You need to navigate away then back again.

When you navigate back, the URL changes from "http" to "https" which I think fixes the problem. Any ideas how I fix this?

Update:

Ok I also realized that this should not always be "https", because the cart block might be displayed on the side while you're in a product page for example!! Any thoughts on this?
