Showing product that is not in stock in size needed

Hello,

 

I will do my best to explain but I've added photos to hopefully help people understand.

 

We're using the catalog sidebar thing for people to be able to do a break down for their search. However, when wanting to see things that are only available (in stock) and in a certain size it still shows product that is out of stock. 

Like I said, I've attached photos to better understand what I mean. 

 

Is there a way to fix this and if so could you please be a descriptive as possible on how to make it happen.
