[PS 1.6] Stop the Mail Alerts module from sending out mail to customer when stock is available if the product is disabled

I have some products that are disabled and when I add stock to the product and the a customer has already subscribed to stock notifications, they still get an email.
The problem with that is that when they go and look for the product it's not there.

How can I stop the Mail Alerts module from sending out mail to customer when stock is available IF the product is disabled?

What should I change the code to in the mailalerts.php?
